  1. NightShade Computing License Agreement

  3. BEFORE USING THIS SOFTWARE, CAREFULLY READ THE TERMS AND CONDITIONS OF
  4. THIS AGREEMENT.  BY USING THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND
  5. BY AND ARE BECOMING A PARTY TO THIS AGREEMENT.  IF YOU DO NOT AGREE TO
  6. ALL OF THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.

  8. 1. NightShade Computing ("NightShade") grants to you a non-exclusive,
  9. non-sublicensable, license to use this version of Sentry (the
  10. "Software"), in binary executable form.
  11.  
  12. 2. The software is provided 'as is' without express or implied
  13. warranties, including warranties of merchantability and fitness for a
  14. particular purpose or noninfringement.  NightShade shall not be liable
  15. under any theory or any damages suffered by you or any user of the
  16. software.

  18. 3. Title, ownership rights, and intellectual property rights in and to
  19. the Software shall remain in NightShade.  You agree to abide by the
  20. international copyright laws and all other applicable laws of Canada
  21. including, but not limited to, export control laws.  You acknowledge
  22. that the Software in source code form remains a confidential trade
  23. secret of NightShade and therefore you agree not to modify the Software
  24. or attempt to decipher, decompile, disassemble or reverse engineer the
  25. Software, except to the extent applicable laws specifically prohibit
  26. such restriction.

  28. 4. NightShade may terminate this License at any time by delivering
  29. notice to you and you may terminate this License at any time by
  30. destroying or erasing your copy of the Software.  Upon termination of
  31. this License, you agree to destroy or erase the Software.  This License
  32. is personal to you and you agree not to assign your rights herein.  This
  33. License shall be governed by and construed in accordance with the laws
  34. of Canada and, as to matters affecting copyrights, trademarks and
  35. patents, by Canadian federal law.  This License sets forth the entire
  36. agreement between you and NightShade.

  38. 5. NightShade shall not be liable for (a) incidental, consequential,
  39. special or indirect damages of any sort, whether arising in tort,
  40. contract or otherwise, even if NightShade has been informed if the
  41. possibility of such damages, or (b) for any claim by any other party.
  42. This limitation of liability shall not apply to liability for death or
  43. personal injury to the extent applicable law prohibits such limitation.

  45. 6. From time to time NightShade may, in its sole discretion, advise the
  46. End-User of updates, upgrades, enhancements or improvements to the
  47. Software and/or new releases of the Software (collectively,
  48. "Enhancements"), and may license the User to use such Enhancements upon
  49. payment of prices as may be established by Licensor from time to time.
  50. All such Enhancements to the Software provided to the End-User shall
  51. also be governed by the terms of this License. IN ORDER FOR THE END-USER
  52. TO BE ASSURED THAT IT WILL BE ADVISED OF AND LICENSED TO USE ANY
  53. ENHANCEMENTS TO THE SOFTWARE, THE END-USER MUST REGISTER THE SOFTWARE.
